The concept of publication from a defamation perspective in the era of digital publications

The object of this paper is to consider recent observations by various members of the High Court made across three significant decisions concerning the issue of publication from a defamation perspective. The appeals arose in the contexts of assessing the results produced through using internet search engines, the significance of search engine results which contain hypertext links capable of being accessed by a ‘click’ of a mouse, to lead an interested reader to another electronic linked source, and then, the responsibility of internet website operators of web pages for what are the unsolicited defamatory comments posted by third parties accessing those websites and posting their own defamatory material.
